Scoble talks about this in depth and you can read his comments for his take. This is a ridiculous fallacy of course. For example, if a Doctor goes to medical school, works hard and eventually recovers the cost of education, should that person no longer charge a fee? No one would argue that. Why value intellectual property or creative works any less? What I find most disingenuous is those that make these claims have NO problem applying it to any realm that doesn't affect THEIR livelihood. It's always about what other people produce that seems to be undervalued.

Eben Moglen asks an interesting question: "If I can provide to everyone all goods of intellectual value or beauty, for the same price that I can provide the first copy of those works to anyone, why is it ever moral to exclude anyone from anything?
